IS BANKRUPTCY MY ONLY CHOICE?
No, it isn't. Nearly a hundred years ago we Canadians decided that we needed a law that was effective enough to resolve financial problems between people when no other solution would work. We called it the Bankruptcy Act and, though like any other law it was not a perfect solution, it worked. Since then we have tweaked it in many ways to keep it up-to-date and effective. We even changed its name to the Bankruptcy and Insolvency Act, but the main thing is that it is still the primary legal solution and IT STILL WORKS. In the 21st century over 100,000 Canadians a year need to use the BIA to solve their debt problems.
The modern version provides you with another option besides a Bankruptcy. It's called a Proposal. This is a process whereby you try to make a new arrangement with your unsecured creditors. If a sufficient majority of your creditors accept your proposal, and the court approves it, all your debts are reduced to one payment per month - made directly to the trustee.
Though most people prefer to do a Proposal instead of a Bankruptcy, it may not be possible for everyone. You have to have something to offer which the creditors will be willing to accept. For most people that is a pay cheque. In other words, they make an offer based on what they can afford to pay each month. If the offer is reasonable and the creditors see that a real effort is being made, they will normally accept a compromise.
